Application of Terms

These service terms apply to all goods and services supplied by Yarrow Group Pty Ltd, trading as Yarrow Field Maintenance (the Company), unless otherwise agreed in writing. By requesting services, accepting a quotation, placing an order, or allowing work to commence, the Customer agrees to be bound by these service terms.

Services

The Company provides  maintenance services, including mechanical, maintenance, repair, inspection, diagnostic, and technical services to equipment, vehicles, machinery, and associated systems. Services may be performed onsite, in the field, or at other agreed locations.

Quotations

All quotations are valid for 30 days unless otherwise stated. Quotes are estimates based on information available at the time and may change if additional faults are discovered, the scope of work changes, or parts and materials pricing varies.

Pricing

All prices are in Australian Dollars and exclusive of GST unless otherwise stated. Additional charges may apply, including travel time, mobilisation, call-out fees, after-hours labour, freight, parts, consumables, and specialised equipment.

Payment Terms

Payment is required Cash on Delivery (COD) unless otherwise agreed upon in writing by Yarrow Group Pty Ltd.

Late Payments

Failure to make payment by the due date will result in five percent of the outstanding invoice amount being charged every seven (7) days until the balance is paid in full. If no payment is recieved seven days after the due date, outstanding amounts will be sent to the recovery department.

Costs of Recovery

The debtor/s shall pay for all costs actually incurred by Yarrow Group Pty Ltd in the recovery of any monies owed under this Agreement. The Customer agrees to be liable for and indemnify Yarrow Group Pty Ltd. These costs include recovery agent costs, repossession costs, location search costs, process server costs, solicitor costs on a solicitor/client basis, debt collection commission, and legal fees on an indemnity basis.

Minimum Call-Out

After hours work is subject to a minimum call-out period of four (4) hours labour plus travel time and mobilisation. 

Operating Hours

Monday to Friday 08:00 am - 05:00pm

Outside of these hours is classed as call-out

Travel and Remote Work

Where work is performed outside the Company’s standard operating area or in remote locations, all costs associated with performing the work will be charged at cost plus fifteen percent (Cost +15%) to cover administration, logistics, and overhead. 

Fuel Levy may be charged at the directors discretion, depending on the cost associated with the booking.

Equipment Storage

Equipment left with the Company must be collected within seven (7) days of notification that work is complete. Storage fees may apply thereafter.

Abandoned Equipment

Equipment remaining unpaid and uncollected for more than sixty (60) days after written notice may be deemed abandoned and disposed of in accordance with applicable law.

Limitation of Liability

To the maximum extent permitted by law, the Company will not be liable for loss of production, loss of profits, business interruption, equipment downtime, or consequential loss. Liability is limited to the value of services supplied.

 Governing Law

These service terms are governed by the laws of Queensland, Australia.
